1. In these terms and conditions (where not inconsistent with the context): "Baggage" includes Check-in Baggage and Carry-on Baggage. "Booking" means the booking entry made with and accepted by the Airline in relation to the travel sought by or on behalf of the passenger, the boarding pass, the baggage check and/or any other document or message of the Airline relating to the contract for carriage concerning such travel. "Airline" means the airline, which accepts the Booking, and all airlines that provide transport and services the subject of the booking to the passenger and any of that airline’s agents, servants, representatives, contractors, subsidiaries or related bodies corporate. "Carry-on Baggage" means baggage, personal effects or other articles (not being Check-in Baggage), which accompanies the passenger during the provision of transport and services the subject of booking. "Convention" means (as applicable), the Convention for the Unification of Certain Rules Relating to International Carriage by Air (1929) ("Warsaw Convention"), the Warsaw Convention as amended at The Hague (1955), the Warsaw Convention as amended by Additional Protocol No. 1 of Montreal (1975), the Warsaw Convention as amended at The Hague and by Additional Protocol No. 2 of Montreal (1975), the Warsaw Convention as amended at The Hague and by Additional Protocol No. 4 Montreal (1975), the Guadalajara Convention (1961) and the Montreal Convention (1999). "International Travel" means international carriage as defined in the Convention and includes any scheduled flights operated in Samoa or American Samoa and approved chartered flights operated within Samoa and American Samoa, which forms part of an international trip. "Fare Rules" means those additional terms and conditions attaching to the transport and services the subject of the booking of which the passenger is notified at the time of booking. "Passenger" means the person specified as receiving transport and other services in the Booking and any child or infant or Baggage carried with that person. "Loss" means any loss, damage, cost or expense, including consequential or indirect loss, loss of profit or loss of opportunity. "Check-in Baggage" means baggage, personal effects or other articles registered with the Airline as baggage intended to be carried in the aircraft hold during the provision of transport and services the subject of the Booking and for which a bag tag number is issued by the Airline. 2. This itinerary and receipt does not constitute a document of carriage and in the event of any differences between it and the record of Booking in Polynesian Airlines’ (hereinafter referred to as “Polynesian”) databases, the latter will prevail. Polynesian carries passengers on flights in Samoa and American Samoa and elsewhere on contracts that consists of these Terms and Conditions: Polynesian’s General Conditions of Carriage (Passenger and Baggage) available on request and any applicable tariffs filed by Polynesian with regulatory bodies; International conventions and Samoan and American Samoa laws; Polynesian’s oral or written directions to passengers. In the event of any inconsistency between these Terms and Conditions and the General Conditions of Carriage, the General Conditions of Carriage shall prevail. If Polynesian issues an electronic ticket, itinerary or a boarding pass for another airline’s flight, it does so only as an agent for that airline. Unless otherwise stated, an electronic ticket or itinerary is valid for one year from the date of issue. Polynesian will use efforts to carry you and your baggage reasonably in accordance with the date and time of the flight(s) specified but does not guarantee it will be able to do so due to unforeseen circumstances beyond its control. Schedules may change without notice. You must comply with all applicable government travel requirements including obtaining visas and permits to enter the countries to which you are traveling to and check-in by the required check-in time. The contract between you and Polynesian including any exclusion or limitation of liability applies to benefit Polynesian employees, agents and representatives. All other airlines used by Polynesian to carry you including their employees, agents and representatives and Polynesian hold that benefit on trust for them and can if requested by them enforce it on their behalf. 3. Fares & Fees Fares are subject to availability at the time of purchase. Fares and schedules are subject to change without prior notice. Fares are subject to the following change and cancellation fees once electronic itineraries have been purchased and issued: For Apia / Pago Pago / Apia tickets – WST50.00 per change per person For Pago Pago / Apia / Pago Pago tickets – USD20.00 per change per person Change and cancellation fees apply to Adult and Child fares only. Infants are exempt from these fees. Fares are non-refundable (unless under exceptional circumstances which have to be approved by the Airline) once electronic itineraries have been purchased and issued. The value of these fares less the applicable cancellation fees can be transferred towards a voucher to be utilized for future travel to be taken within 12 months from the date of the original cancellation. Unused vouchers will expire after 12 months and will automatically have no value. Vouchers are transferable. Failure to change or cancel your reservation prior to flight departure constitutes a no-show, in which case a no-show penalty fee of 50% of the base fare will apply plus the change or cancellation fee. 4. Baggage In referring to “Baggage”, we mean both the baggage carried on by you and the baggage carried for you either on or in conjunction with your flight. All baggage is carried subject to these conditions and you must comply with them. Polynesian reserves the right to search you and/or your baggage to ensure compliance. Each fare paying passenger is entitled to free baggage allowance for carry-on baggage and check-in baggage as detailed below: Free Baggage Allowance Carry-on Baggage For adult passengers over 12 years - 1 piece up to 115cm (45in) and a maximum weight that does not exceed 5 kilograms per adult. For child and infant passengers up to 11 years inclusive – 1 piece up to 115cm (45in) and a maximum weight that does not exceed 3 kilograms per child/infant. Check-in Baggage For adult passengers over 12 years - Up to 2 pieces with a maximum combined total weight of 20 kilograms (44lbs). The sum of three dimensions (height + width + length) cannot exceed 62 inches on any piece. 1 piece with a maximum total weight of 15 kilograms (33lbs) for children passengers 2 to 11 years inclusive and 10 kilograms (22lbs) for infant passengers less than 2 years. The sum of three dimensions (height + width + length) cannot exceed 39 inches on any piece. Polynesian charges excess baggage fees for check-in baggage over the designated free baggage allowance. Please refer details below: Excess Baggage Charges Polynesian Airlines charges excess baggage fees on its following sectors for check-in baggage over the designated free baggage allowance: From Apia to Pago Pago WST3.00 per excess kilogram From Pago Pago to Apia USD2.00 per excess kilogram Please note that all excess baggage accepted by Polynesian Airlines for check-in are subject to availability of space and weight at the time the flight closes. You must ensure your baggage’s dimensions comply with those stipulated by the Airline. If you are traveling in a group, you may combine your baggage entitlement provided that the weight of no individual item exceeds 20 kilograms. We may refuse to carry any baggage, which in our view is unsuitable for carriage for any reason. Due to space and weight restrictions on a smaller aircraft type, Polynesian cannot carry large items such as bicycles and surfboards. Wherever practical, we will carry your baggage on the same flight as you. If this is not practical, for any reason then we will carry your baggage on the next flight having space and load capacity to accommodate it. Subject to the provisions of these terms and conditions of carriage, the Convention and any applicable laws, Polynesian is not liable for or in connection with any loss sustained to baggage, including (without limitation) loss, which is solely the result of normal wear and tear. Subject to the provisions of these terms and conditions of carriage, Polynesian’s liability for personal injury or death of a passenger and for loss of or damage to the baggage is limited by the Convention. For most international travel, Polynesian’s liability for check-in baggage is limited to approximately USD20.00 per kilogram and liability for carry-on baggage to a maximum of approximately USD400.00. If the weight of a passenger’s check-in baggage is not recorded on the baggage check, it is presumed that the total weight of the check-in baggage does not exceed the applicable free baggage allowance. If a whole item of your check-in baggage on a Polynesian flight has been lost or destroyed, you must notify Polynesian in writing within 21 days or if part only of an item has been lost, destroyed or damaged, within 5 days. Except as provided for under the relevant provisions, Polynesian is not liable for loss, damage to or delay in the delivery of fragile or perishable articles, cash, credit cards, deeds, passport and other travel documents, securities, business documents or other valuable documents, jewellery, antiques, precious metals or other similar valuable items, electrical or electronic components such as cameras, computers, medicines, or any other item that has insufficient packaging to withstand the normal circumstances and effects of carriage by air, which are included in the passenger’s check-in baggage, whether with or without the knowledge of Polynesian. Such personal valuable items should be carried on your person or in your carry-on baggage under your care. Passengers must remove all carry-on baggage from the aircraft before disembarking and collect their check-in baggage as soon as it is made available for collection. Baggage that are not removed from the aircraft or not collected by the passenger will be disposed of by Polynesian (without any liability to the passenger) if it is not claimed within 10 days after the flight. Polynesian is not liable for any loss suffered by a passenger who has failed to remove all carry-on baggage from the aircraft on disembarkation. 5. Special Services Polynesian Airlines offers the following special services at a nominal fee: Unaccompanied Minors - WST30.00 for travel Apia / Pago Pago / Apia and USD30.00 for travel Pago Pago / Apia / Pago Pago Wheelchairs - WST30.00 ex Apia and USD30.00 ex Pago Pago 6. Check-In Times Due to heightened security measures worldwide, Polynesian Airlines requires you to check-in 2 hours prior to the scheduled departure time of your flight. Polynesian Airlines’ check-in counters will close 30 minutes prior to the scheduled departure time of flights to allow the airline to complete all the necessary paperwork and clearances required from government and aviation authorities in order to dispatch your flight on time. Polynesian Airlines will not accept you for check-in if you turn up when the check-in counters have closed even if your flight is still at the gate and has not departed. Failure to check-in on time can result in your being denied boarding and can lead to additional costs in the form of change/cancellation fees and additional collection of airfares if the airline applies the no-show penalty fee. 7. Identification at Check-In All passengers including children and infants must produce a valid identification at check-in either in the form of an official travel document such as a Passport or Certificate of Identity with the applicable visa or entry permit and their itinerary from Polynesian Airlines. Polynesian Airlines has the right to refuse carriage for any passenger whose travel documents do not comply with the entry requirements of the country of his or her destination. 8. International Notice – Limitation of Liability If your trip has a destination or stop in another country other than the one from which you depart, a treaty know as the Warsaw Convention may govern the liability of all airlines involved in your trip and may limit the amount of damages that can be recovered for your death or injury. These limits can be as low as USD10,000. However, many airlines have voluntarily agreed to waive those limits in whole or part. 9. Seating Polynesian does not guarantee you any particular seat even if your reservation is confirmed. You must accept any seat allotted to you on the flight at the time of check in. 10. Reservations Not Guaranteed If you have a confirmed reservation, we will do our best to ensure you have a seat on the flight requested but we are unable to guarantee you that seat whatever the “confirmed reservation” or other status of your booking. We reserve the right to cancel any flight at any time although we will do our best to give you reasonable notice of any cancellation subject to your providing us with contact details at the time of booking. Where we cancel a scheduled service before you are accepted at check-in and issued with a boarding pass, we will not be responsible for any expenses incurred by you as a result of that cancellation. 11. Flight Delays Although Polynesian will use its best efforts to ensure flights operate according to scheduled times, our performance cannot be guaranteed as it can be affected by a variety of factors including but not limited to industrial action, landing restrictions, airport loading restrictions, operational, safety, logistical, weather or emergency requirements affecting the aircraft, force majeure and by other matters outside of our control or matters arising from our carriage of other passengers. We reserve the right to substitute alternate aircraft or carriers for any carriage and flight schedules may change without prior notification. We reserve the right to offload or not to carry any passenger or baggage. This is a decision for the staff of Polynesian in their discretion taking into account weight limitations, seating capacity and other issues including matters affecting safety. Where a delay is caused through circumstances which are within our reasonable control and that delay exceeds 4 hours and you have been checked in and received a boarding pass and you are not a resident of the country where your flight is departing from, we will provide you with a meal where the delay extends through a normal meal time together with hotel accommodation of our choice if the delay extends overnight. Polynesian imposes limitations on the costs and types of services provided to you at the hotel we use to accommodate you during the flight disruption. Polynesian’s responsibility for meals and accommodation shall extend only as far as your arrival at the final destination to which we have contracted to carry you. If we are unable to undertake or continue any flight or to carry you, we will try to provide alternative carriage at the earliest practical opportunity. If, for any reason, that should not be possible you may either re-book with us or receive a refund. If you are refused carriage with us for any reason (except where you are late for check-in, miss your flight or that refusal is due to any other fault of your own) you may, depending on the fare type you purchased, be eligible to receive a refund for that flight. 12. Flight Connections Polynesian will not under any circumstances offer, provide or guarantee connections between the flights it offers and the flights of another airline or any other form of transport and subject to the provisions of these terms and conditions of carriage and any applicable laws, Polynesian is not liable in any way for or in connection with any loss which a passenger may incur as a result of any such flight failing to connect with the flight of another airline or another form of transport. 13. Overbooking Notice There is a chance a seat will not be available on a flight even if your reservation is confirmed. This is due to the common practice in the airline industry of overbooking. People involuntarily denied boarding as a result of overbooking might apply for compensation in accordance with Polynesian’s policy. 14. Travel Formalities We require you to check in at least 2 hours prior to the scheduled departure time of your flight as set out in your receipt and itinerary. Your “ticket” will comprise the receipt and itinerary, the electronic flight coupons or other value documents held in our database in electronic form and if applicable (if, for instance, if you have not by the time of presenting yourself to our check-in counter accepted our terms and conditions) any document which permits you to board our aircraft for carriage. Your booking will be allocated a unique confirmation or reservations number, which should be used by you for confirmation of your booking and check in formalities. You are required to provide personal identification in the form of an official travel document such as a Passport or Certificate of Identity and in the case of persons traveling on any child or infant fares or senior citizens fares, evidence of age. We will cancel your booking and reallocate your seat to another passenger on stand-by if you fail to turn up at check-in 30 minutes prior to the scheduled departure time of your flight. It is your responsibility prior to travel to check and ensure your travel documents are in order and valid for use and that you possess the required visa and entry permits to enter your final destination. Polynesian reserves the right to refuse you carriage if your travel documents are not in order. In all such cases, you will forfeit your reservation and any payment for it and the applicable penalty and no-show fees of the airline will apply. 15. Government and other Taxes and Charges The price of your ticket may include significant amounts of taxes, charges and fees imposed on air transport by governments, authorities and airport operators (in the fare, eg: Goods and Services Tax or shown separately as a Tax/Fee/Charge). You may also be required to pay additional taxes, fees or charges not marked on your ticket. Some USA airports may impose Passenger Facility Charges (PFCs) of up to USD4.50 to finance airport related projects. PFCs may not exceed USD18.00 per ticket. 16. Insurance Personal and baggage insurance is recommended. Please consult with Polynesian or your Travel Agent. 17. Searches Polynesian, government or airport officers may require you to submit to clothing and body searches or require you to submit your baggage to searches or inspections and search or inspect your baggage with or without your knowledge. Passengers must comply with all applicable laws, regulations, orders and notifications in force relating to air transport and all conditions and instructions of the Airline. 18. Security Message Polynesian Airlines takes security of its passengers onboard its flights very seriously. Any individual who exhibits disruptive or threatening behavior will not be allowed to board or will be removed from the flight. Federal legislation permits penalties to include substantial fines, imprisonment or both for any person convicted of making threats against aviation even if they are made as a joke or hoax. In addition to any action law enforcement agencies may take against you as a result of such threats, Polynesian Airlines reserves the right to seek recovery of any financial loss suffered as a direct or indirect result of any joke or hoax threats. 19. Right to Refuse Carriage Polynesian reserves the right to refuse carriage to any person who seeks to travel in violation of applicable law, tariffs or General Conditions of Carriage or is otherwise in breach of these Terms and Conditions or under the influence of drugs or alcohol or it is necessary for the safety or comfort of other passengers or for the protection of property or is not physically or mentally fit to travel or requires medical or other special assistance in order to comply with any applicable laws, regulations or orders of any state or country to be flown from into or over. In all such cases, Polynesian is not liable for any loss, which the passenger incurs as a result. 20. Smoking Smoking is not permitted on any Polynesian aircraft. 21. Dangerous Goods Warning: If you illegally take dangerous goods on the aircraft, even inadvertently, you may be liable for prosecution and fines of up to $12,000. For safety reasons, the following types of Dangerous Goods must not be taken onboard any Polynesian aircraft: Explosives: fireworks, flares, toy gun caps Compressed Gases: gas cylinders, aerosols (other than medicines and toiletries for personal use – refer Separate Heading Liquids, Aerosols and Gels (LAGs) Flammable Substances: lighter fuel, paints, thinners, firefighters, cigarette lighters containing unabsorbed lighter fuel Oxidizers: some bleaching powders, acids and chemicals Organic Peroxides: hair or textile dyes, fiberglass repair kits, certain adhesives Toxic Substances: arsenic, cyanide, weed killers Irritating Materials: tear gas devices such as mace, pepper sprays Infectious Substances: biological products and/or diagnostic specimens containing pathogens Radioactive Materials: medical or research samples which contain radioactive sources Corrosives: acids, alkalis, wet cell batteries, caustic soda and mercury Magnetized Materials: magnetrons, instruments containing strong magnets Security-type attaché cases: cash bags or cash boxes that contain lithium batteries and/or pyrotechnic material Mechanical Engines: chainsaws, lawnmowers, brush cutters and the like Medicines and toiletries containing alcohol may be carried in limited quantities in Check-in or Carry-on baggage – no more than 0.5 litre or 0.5 kilograms per item up to a maximum of 2 litres or 2 kilograms. Small arms, sporting ammunition and dry ice may be carried in limited quantities under certain conditions. Please ask Polynesian for details. Firearms are not permitted in the cabin. 22. Liquids, Aerosols and Gels (LAGs) The following constitute the new rules for taking Liquids, Aerosols and Gels (LAGs) through security onto international flights. For more information, please visit our website www.polynesianairlines.com. All Liquids, Aerosols or Gels that you intend to take in your Carry-on baggage must be in containers 100 millilitres in volume or smaller (This is about equal to 100gm in weight). Any containers larger than 100 millilitres will need to be packed into your Check-in Baggage or left behind. Partially filled containers larger than 100 milliltres will not be accepted. The containers that you intend to take in your Carry-on Baggage must be packed into a transparent, resealable plastic bag which must not be greater than 1 litre in size for example 20x20cm or 15x25cm. At the security screening point, you will have to surrender any Liquids, Aerosols or Gels greater than 100 millilitres that you still have with you, including duty free. These items will be confiscated and destroyed by the Airport authorities and Polynesian will not accept any liability for such items. NOTE: In many airports, you will be able to purchase or collect items like duty-free and drinks after you have passed through the screening point for your international flight. The new rules also introduce random frisk searches as part of the screening process. 23. Flight Reconfirmation of onward and return reservations If you break your air journey at any point, you must reconfirm your onward or return travel. To reconfirm a flight: Contact the reservations office of the Airline at the city from which the flight departs. State your definite intention to use your reservation and give your local telephone number or address. You must do this at least 48 hours before departure if your stay is to exceed 48 hours OR immediately if your stay is less than 48 hours. Failure to reconfirm will result in the cancellation of your confirmed reservation and seat and Polynesian will not be liable for any costs you incur as a result of this cancellation. 24.
